These Terms of Use govern the use of the RoutiPlan app for iPhone and iPad. The German version is authoritative.

Licence agreement

The licence for the app obtained through the App Store is governed by Apple’s Standard Licensed Application End User License Agreement (EULA). RoutiPlan does not use a custom EULA. The following terms supplement the Apple EULA with product-specific rules and do not replace it. In case of conflict, the Apple EULA prevails insofar as it concerns the licence to the app.

Availability

RoutiPlan is intended to be available in the countries and regions Apple offers for distribution, with a focus on Germany, Austria and Switzerland. Actual availability depends on the respective App Store approval.

Purpose of the app

RoutiPlan helps families organise everyday life together, in particular with tasks, events, rewards, points, a shopping list and recipes. RoutiPlan is intended for private, non-commercial use within a family.

Account and family

• An account is required to use RoutiPlan. The information provided when registering must be accurate.
• An account is personal. Sign-in details, invitation codes and unlocked devices must be protected against unauthorised access.
• Parents manage the family, its members, roles and approvals. Inviting a co-parent grants them the same administrative rights.
• You can delete your account at any time in the app under Settings. The consequences for the family’s content are described in the Privacy Policy.

Children

RoutiPlan is intended for parents and legal guardians. Children use the app within a family managed by their parents, either as a profile without their own account or with their own account, which can only be created through an invitation from a parent.

Parents are responsible for ensuring that the information about their children is lawful and limited to what is necessary, that they have given any required consent and that children use the app in an age-appropriate way and under supervision.

Tasks, approvals, points and rewards

RoutiPlan helps organise and confirm tasks. The app does not check whether a task was actually or correctly completed; the parents decide this.

Points and rewards are organisational aids within the family. They have no monetary value, cannot be converted into money or transferred, and do not create any claim against Xvision Solutions. Which rewards exist and whether they are granted is decided solely by the family.

Content

Users retain the rights to the content they create, such as tasks, events, recipes and photos. To operate the service, they grant Xvision Solutions the non-exclusive right, limited to the duration of use, to store and transmit this content and to make it available to the authorised members of the family and, for explicitly shared events, to the respective other family.

Content that is unlawful, offensive or infringes the rights of third parties must not be entered, in particular no photos of or information about other people without their authorisation.

Permitted use

In particular, the following is not permitted:

• circumventing access or security mechanisms or attempting to access other families’ data
• automated or excessive use that impairs operation
• use for commercial or unlawful purposes

Costs and in-app purchases

RoutiPlan is currently free of charge and contains no advertising. Optional extra features may be offered for a fee in the future. The core features for tasks, events, points, rewards and child profiles are not affected by this.

Paid offers are processed exclusively through Apple In-App Purchase. Price, scope and, where applicable, term are shown in the app before purchase. Apple’s terms apply to purchase, billing, renewal, cancellation and refunds; subscriptions are managed and cancelled in the Apple Account settings.

Availability of the service

RoutiPlan depends on an internet connection and on third-party services. We strive for reliable operation but cannot guarantee uninterrupted or error-free availability. Maintenance, security measures, technical faults or changes to third-party services may temporarily restrict features. Users should not keep information that is important to them exclusively in RoutiPlan.

Liability

To the extent permitted by law, the liability of Xvision Solutions for slight negligence, indirect damage, consequential damage and loss of data is excluded. Liability for intent and gross negligence, for injury to life, body or health and under mandatory statutory provisions, in particular mandatory consumer protection law, remains unaffected. Where mandatory law provides for liability for a slightly negligent breach of essential contractual obligations, such liability is limited to the foreseeable damage typical for the contract.

Changes to the app and these terms

RoutiPlan is being developed further; features may change, be added or be removed. These terms may be updated if features, legal requirements or security requirements change. We will inform you of material changes in an appropriate manner, for example in the app.

Termination

You can end your use at any time by deleting your account. In the event of serious or repeated breaches of these terms, we may restrict or terminate access to the extent necessary.

Privacy

Information on the processing of personal data is provided in the Privacy Policy, available in the app and on routiplan.app.

Governing law and place of jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the place of jurisdiction is the place of business of Xvision Solutions. Mandatory provisions protecting consumers, in particular regarding their place of jurisdiction and the law applicable in their country of residence, remain reserved.
